2024年广东省知识产权保护状况
2024年,广东省坚持以习近平新时代中国特色社会主义思想为指导,认真学习贯彻落实党的二十大和二十届二中、三中全会精神,深入贯彻落实习近平总书记关于知识产权保护工作的重要指示精神和视察广东重要讲话、重要指示精神,全面落实省委和省政府工作要求,大力实施《知识产权强国建设纲要(2021—2035年)》《关于强化知识产权保护的意见》和《“十四五”国家知识产权保护和运用规划》,建立高效的知识产权综合管理体制,扎实推进知识产权领域改革任务,统筹推进知识产权战略实施,加强知识产权法治保障,完善知识产权全链条保护机制,纵深推进知识产权强国先行示范省和国际一流湾区知识产权强省建设。
一、全面统筹推进知识产权保护工作
加强统筹谋划。广东省委、省政府高度重视知识产权保护工作,省委全面深化改革委员会会议专题研究知识产权相关工作;省政府常务会议研究部署知识产权重点工作。省政府与国家知识产权局围绕“世界一流湾区知识产权强省”主题开展共建,起草共建国际一流湾区知识产权强省2025—2026年工作要点,打造粤港澳大湾区知识产权国际合作高地。
强化法治保障。持续实施《广东省知识产权保护条例》《广东省版权条例》《广东省地理标志条例》等地方性法规。印发《广东省专利转化运用专项行动实施方案》等政策文件,大力推动专利产业化。省知识产权战略实施工作联席会议办公室印发《广东省知识产权强省建设和“十四五”规划实施2024年度推进计划》。省市场监管局(知识产权局)会同省司法厅印发实施《关于加强新时代专利侵权纠纷行政裁决工作的实施意见》,出台《广东省市场监督管理局关于全面提升知识产权公共服务效能支持全面创新的行动计划(2024—2026年)》。
推进试点示范。广州、深圳深化国家知识产权保护示范区建设。持续建设10个国家知识产权强市建设试点示范城市、21个强县建设试点示范县、8个强国建设试点示范园区。全省共建设广州、深圳、珠海、佛山、江门等5个全国商业秘密保护创新试点地区,数量位居全国第一,累计建设24个“黄金内湾商业秘密保护创新工程”先行区,其他各类保护基地、服务站点900多个。“广东省广州开发区创设多项知识产权海外险,助企出海远航”“广东高校科技成果转化中心加速高校专利转化”等2项经验,入选知识产权强国建设第三批典型案例。
二、大力深化湾区知识产权协同发展
加强粤港、粤澳知识产权合作。实施《粤澳知识产权合作协议(2023—2025年)》,签署《粤港知识产权合作协议(2024—2025年)》,促进湾区知识产权合作交流,推动大湾区高质量发展。不断加强与香港、澳门特别行政区政府知识产权部门协同,联合举办粤港澳大湾区“知识产权创造运用大会”“知识产权交易博览会”“高价值专利培育布局大赛”“高价值商标品牌培育大赛”“知识产权人才发展暨人才供需对接”等系列品牌活动,在香港举办亚洲知识产权营商论坛“粤港澳大湾区分论坛”,充分发挥粤港澳大湾区知识产权品牌活动的溢出效应,举办2024年内地与香港特区、澳门特区知识产权研讨会及泛珠三角区域知识产权公务人员交流活动,“深圳-香港-广州”科技集群创新指数连续5年位居全球第二。
推动大湾区重点区域知识产权改革创新。中新广州知识城持续深化新一轮知识产权运用和保护综合改革试验,省委依法治省办印发《关于支持中新广州知识城建设知识产权法治保障标杆区的工作方案》,全力支持中新广州知识城建设全国首个知识产权法治保障标杆区。广州知识产权法院聚焦涉外法治建设需求推动新设集中审理涉外、涉港澳案件的南沙法庭。广州市南沙区启动运行粤港澳创新创业知识产权综合服务平台。河套获批建设国家知识产权运营(深圳河套)国际转化试点平台。广州开发区建设知识产权数字化集成服务平台。
三、从严加强知识产权司法保护
充分发挥知识产权审判职能作用。2024年,全省法院新收各类知识产权案件83308件,同比减少8.54%;审结88462件,结收比106.19%,同比提高2.36%;存案11337件,大幅减少31.17%;大力开展纠纷矛盾实质化解工作,调撤结案50932件,调撤率同比上升4.89%;审判质效总体提升,办案效果持续向好。加大知识产权司法保护力度,全省知识产权民事案件赔偿额达88.5亿元。审结百度网盘“离线下载”侵权纠纷案,创造性地提出云存储领域“两预防一阻止”治理要义及裁判规则,促进网络空间数字经济规范发展。审结潮州木雕非物质文化遗产案,探索加强国家非物质文化遗产司法保护、振兴传统工艺的广东路径,保护和弘扬中华优秀传统文化。积极行使中国法院司法管辖权,妥善高效化解一批科技创新企业的涉外知识产权纠纷,促成国内国际纠纷一揽子和解。全省法院精品案例工程成果丰硕,审结的“调用服务器API接口抓取并交易微博数据案”入选中国法院2023年度十大知识产权案件,4篇知识产权民事判决书获评第六届、第七届全国百篇优秀裁判文书,联合利华公司诉郭某等侵害商标权及不正当竞争纠纷案等3案入选中国外商投资企业协会优质品牌保护委员会十佳案例。组织“法官百企面对面”知识产权保护宣讲活动,由资深法官组团“零距离”精准普法、答疑解惑,积极回应企业创新、产业发展的司法需求。
持续加强知识产权检察工作。2024年,全省检察机关持续加大侵犯知识产权犯罪打击力度,批准逮捕侵犯知识产权犯罪案件1265件1854人,同比分别上升64.29%、68.24%;起诉1779件3192人,同比分别上升61.73%、62.94%。深入推进知识产权检察综合履职,受理知识产权民事监督案件228件,向法院发送再审检察建议34件;立案办理知识产权领域公益诉讼案件49件,提出检察建议42件,均获得行政机关的支持,国家或社会公共利益得到有效保护。充分发挥法律监督职能,共监督公安机关立案20件20人,监督撤案19件31人。《商业秘密刑事保护体系建设指引(试行)》获国家发展改革委等七部委向全国联合推广。
严厉打击侵犯知识产权犯罪。全省公安机关深入开展“昆仑”专项行动,组织开展打击侵犯知识产权犯罪“蓝剑”专项集中收网行动,对侵犯知识产权和制售伪劣商品犯罪保持高压严打态势,2024年,全省共立知识产权刑事案件2249件,同比增长5.8%;破案1926件,破案率上升10.12%;移送审查起诉2653人,相关刑事案件侦办数量、质量“双提升”。
四、全面深化知识产权行政保护效能
持续加强知识产权行政执法。省市场监管局(知识产权局)组织开展“守护知识产权”、地理标志保护等专项行动,查处知识产权案件3945件,案值8250.06万元,移送司法机关167件,持续加大对知识产权侵权行为的惩处力度。“‘贴窗机切膜预压紧装置’实用新型专利侵权纠纷案”“侵犯‘小米’注册商标专用权案”等5件案件入选2023年度全国知识产权行政保护典型案例,电子取证赋能知识产权执法办案的做法入选国家市场监督管理总局知识产权执法典型做法。持续整治文化市场侵权假冒违法违规经营行为,处理举报投诉2万余件。省林业局深入开展林业知识产权保护专项行动,累计检查林木种苗、花卉经营企业及繁殖、生产场所200余个。省农业农村厅开展春季农资打假专项执法行动,立案查处违法案件279件,移送司法机关8件。2024年全省共核发知识产权领域执法人员证件5036张,已有537家涉知识产权领域执法单位、2.3万余名执法人员上线应用“粤执法”,在线累计办案2733件。
推进专利侵权纠纷行政裁决示范建设。举办行政调解与裁决实践研讨会、知识产权行政保护技术调查官能力提升暨行政保护研讨会等活动,提升各地行政裁决业务能力和规范化办案水平。汕头、中山等地在全国率先委托当地知识产权保护中心、快速维权中心承担专利侵权纠纷行政裁决工作。建立知识产权侵权判定技术咨询与技术调查“双支撑”机制,从中立第三方和行政机关辅助人两个层面为基层行政保护工作提供技术支撑。全省办理专利侵权纠纷案件10445件,其中行政裁决类1433件,出具维权意见类9012件,有效发挥化解知识产权纠纷“分流阀”作用,促进纠纷快速解决,提高维权效率。
强化版权执法监管。省版权局会同省通信管理局、省公安厅、省互联网信息办等单位开展打击网络侵权盗版“剑网2024”专项行动、青少年版权保护季行动、院线电影保护专项行动,持续加大侵权盗版违法行为打击力度,2024年,全省共出动执法人员43667人次,检查场所26655家,累计巡查网站5352家,共查办案件370件,查办版权案件数量和质量进一步提升。广东2个案例入选第一批版权强国建设典型案例。
加强知识产权海关保护。海关总署广东分署开展“龙腾2024”“蓝网行动”“净网行动”等专项执法行动,2024年,省内海关实际查扣侵权商品14420批次、数量3478万件。联合香港、澳门海关开展粤港澳海关保护知识产权联合执法行动3次,查获涉嫌侵权商品3849批次,数量159万件。
深化重点领域、关键环节知识产权治理。持续推进《商品交易市场知识产权保护规范》《电子商务平台知识产权保护管理》国家标准实施,推进广州白马服装市场等商品贸易市场知识产权保护规范化建设,开展2024网络市场监管促发展保安全专项行动。强化重大活动知识产权保护,高效开展第十五届全国运动会和全国第十二届残疾人运动会暨第九届特殊奥林匹克运动会知识产权保护工作,高标准完成第135届、第136届中国进出口商品交易会(广交会)、第二十届中国(深圳)国际文化产业博览交易会、第十四届中国国际动漫博览会和2024南国书香节等大型展会知识产权保护工作。
五、全方位推进知识产权协同保护
加强知识产权协同保护。省市场监管局(知识产权局)等八部门印发实施《贯彻落实〈知识产权保护体系建设工程实施方案〉任务分工》,与广州知识产权法院、广东省政务服务和数据管理局探索开展数据权益协同保护工作。省法院、省版权局、省文化和旅游厅共同推进KTV行业领域著作权侵权纠纷矛盾源头治理工作,全省法院全年新收涉KTV著作权侵权案件同比下降超三成。广州知识产权法院强化与11个地市市场监管局(知识产权局)“行政调解+司法确认”工作机制的衔接,探索建立涉诉案件专利无效优先审查通道。
深化跨区域保护协作。积极参与十二省市知识产权行政保护协作,推动打通知识产权案件线索移送通道。珠三角9地市召开跨区域知识产权保护工作会议,粤东西北12地市共同签署跨区域知识产权合作框架协议。健全珠三角、粤东、粤西、粤北版权执法协作机制。粤闽赣的三地市建立全国首个跨省陶瓷类地理标志司法保护协作机制。广州、深圳、北京、上海、西安等地检察机关联合开展“双中心”城市检察机关知识产权协同保护工作。
健全知识产权纠纷多元化解机制。省法院、省司法厅、省侨联、省贸促会等单位进一步健全和完善跨境民商事纠纷多元化解决机制,统筹推进建立健全常态化沟通协调与合作机制。广州知识产权法院作为全国首家试点法院与香港国际调解中心建立诉调对接合作机制。广州仲裁委持续完善融合谈判、调解、仲裁的知识产权在线争议解决机制(以下简称ODR),制定知识产权ODR程序指引,实施“行政处置+仲裁调解”新模式,ODR平台自2021年以来累计办结案件超千件,标的超100亿元,调解率约60%,远超全国仲裁机构办理案件的调解率。省司法厅推动加强知识产权仲裁与司法衔接,深圳国际仲裁院与深圳市福田区法院在河套成立“河套知识产权司法与仲裁协同保护中心”,打造与国际接轨的知识产权纠纷一站式服务平台。全省仲裁机构2024年受理知识产权仲裁案件742件,标的额10.36亿元。全省共有知识产权调解组织167个、调解员1360名,共调解知识产权纠纷6100余件。
完善知识产权快速协同保护体系建设。获批建设广州番禺(珠宝和动漫)、江门开平(水暖卫浴)两家知识产权快速维权中心,全省累计建设15家国家级知识产权保护中心和快速维权中心。2024年依托各国家级知识产权保护中心和快速维权中心受理专利预审申请5.23万件,知识产权保护维权相关案件1.61万件。累计设立6家海外知识产权纠纷应对指导地方分中心,为1000余家企业提供海外纠纷应对指导服务,举办海外知识产权保护培训宣传活动,惠及企业5000余家次。
六、着力强化知识产权高质量创造
持续推动知识产权关键指标领先全国。2024年,全省专利授权量69.26万件,其中发明专利授权量16.88万件;PCT国际专利申请量2.34万件,商标注册量82.45万件,马德里国际商标注册申请量2226件,战略性产业集群发明专利授权量10.87万件;截至2024年底,发明专利有效量79.23万件、高价值发明专利拥有量36.77万件,累计PCT国际专利申请量30.47万件,有效注册商标量906.46万件,均居全国首位。全省著作权登记总量33.22万件,其中一般作品登记4.95万件;计算机软件作品登记28.27万件,占全国计算机软件著作权登记总量的10%,居全国首位。全省新增农业植物新品种权申请量486件(累计3467件),获得农业植物新品种授权84件(累计1252件),获林业植物新品种授权87件(累计380件)。
加强重点产业创新引导。组织开展重点产业专利导航,国家平台备案导航成果448项;获批建设国家级专利导航服务基地9个、国家专利导航工程支撑服务机构3个;建成战略性产业集群知识产权协同运营中心20家,构建专利专题数据库54个,推进产业协同创新。
强化企业创新主体地位。全省累计1.7万多家企业通过知识产权管理国家标准认证;865家企业开展创新管理知识产权国际标准试点,其中通过认证117家;拥有国家知识产权优势示范企业累计1243家;累计建设高价值专利培育布局中心573家。全省8.85万家企业共拥有发明专利68.82万件,占全省专利有效量的87%。
七、加速促进知识产权运用效益释放
完善知识产权转移转化机制。落实《广东省专利转化运用专项行动实施方案》,全面推进专利转化运用专项行动。出台《广东省深化职务科技成果管理改革实施方案(2024—2027年)》《广东省高校和科研事业单位职务科技成果转化尽职免责认定工作指引(试行)》,深入推进高校、科研事业单位职务科技成果管理改革,打通政策法规落地的“最后一公里”。
推进提升专利转化及产业化率。广东超过170家高校和科研机构盘点专利达9.92万件。全省专利出让和受让超过14.1万次,专利许可和被许可1.9万次,专利转化运用日益活跃。新增开放许可专利880件,达成开放许可专利次数439次,组织省内15家试点发布平台与国家专利开放许可平台对接,批量完成试点发布平台已发布专利开放许可信息转入国家平台。全省高校和科研机构专利产业化率提升至7.76%。
推进职务科技成果赋权改革试点和单列管理改革工作。截至2024年底,暨南大学、广东工业大学、省科学院三家试点单位完成1701项成果转移转化,转化合同金额6.57亿元,其中成果赋权753项,协议金额2.31亿元。
加强技术转移体系建设。截至2024年底,全省认定登记技术合同47630项,成交额2845.47亿元,技术交易额2636.10亿元。打造全国性科技成果转化综合服务平台,依托深交所科技成果与知识产权交易中心服务各类科技成果、知识产权和科技企业项目8000余项,促成技术交易33.23亿元。推动华南技术转移中心建设成为国际化、综合型技术转移高端枢纽平台,已汇聚4116名全球高端科技人才为大湾区企业服务,培养技术经纪人超1万名,2390余家企业发布技术需求1763项,1172项关键技术成果对接转化,实现技术交易额超8亿元,带动企业创造经济效益超40亿元。
持续推动知识产权金融服务。2024年,全省专利商标质押融资额3453.97亿元,同比增长49.74%,位居全国第2,惠及企业5067家,其中中小企业4931家;新发行知识产权证券化产品25支,规模逾40亿元。
推进知识产权赋能乡村振兴。实施《广东省发展地理标志产业实施方案》,累计获批建设广东新会等6个国家地理标志产品保护示范区,广东罗定国家地理标志产品保护示范区通过国家知识产权局实地验收。首批广东地理标志驿站顺利建成并投入使用,推动地理标志的普及推广运营。坚持“一镇一策”试点,推动6个地理标志特色镇项目建设,推进知识产权治理向镇街一级延伸拓展,助力乡村振兴和城乡区域协调发展。建立潮州市地理标志司法保护服务中心,探索地理标志保护新路径。截至2024年12月,全省共有地理标志产品166个,另有经农业农村部门登记的农产品地理标志63个。累计1925家地理标志经营主体获准使用地理标志专用标志。
八、高标准建设知识产权服务体系
持续健全知识产权公共服务体系。广州、深圳、佛山建设知识产权公共服务标准化试点城市。全省地市级知识产权公共服务节点21家、技术与创新支持中心(TISC)13家、高校国家知识产权信息服务中心6家、国家知识产权信息公共服务网点11家、商标业务受理窗口22个。开展知识产权公共服务惠企对接活动,签约对接企业1297家。成立广东省知识产权信息公共服务网点联盟。积极总结推广公共服务经验,3个案例入选国家知识产权局2024年度知识产权信息服务“十佳案例”和“优秀案例”。
提升知识产权信息数据供给能力。建设粤港澳知识产权大数据综合服务平台、欧盟商标查询系统、广东省知识产权“一件事”集成服务平台等数字化服务窗口,以及南沙知识产权对比检索服务平台、广州开发区知识产权数字化集成服务平台,收集更新1.88亿条全球专利数据、1亿多条主要国家马德里商标数据、2.5万多条地理标志数据、7.8万条集成电路布图设计数据,为粤港澳大湾区创新主体提供免费数据查询服务。推动全省21个地市上线本地化知识产权公共服务平台,实现知识产权信息供给全覆盖。举办广东省知识产权公共服务机构专利检索大赛。
强化知识产权服务业监管。支持广州开发区、深圳市福田区、广州市越秀区建设国家知识产权服务业高质量集聚发展示范区或试验区。推动省内行业协会制订《广东专利代理协会团体标准管理办法》,强化知识产权服务业行业自律。开展知识产权代理行业“蓝天”专项行动,推进专利代理、商标代理行业实行“双随机、一公开”监管,全省共抽查110家专利代理机构、819家商标代理机构。发布《知识产权尽职调查服务指南》《企业知识产权会计核算指南》等地方标准。
九、积极参与知识产权国际合作
强化与世界知识产权组织合作。世界知识产权组织(WIPO)总干事邓鸿森来粤出席粤港澳大湾区知识产权创造运用大会,副总干事王彬颖出席第六届粤港澳大湾区知识产权交易博览会暨国际地理标志产品交易博览会,推动世界知识产权组织与华南理工大学联合举办2024年中国暑期学校。加强与新加坡、日本、韩国、美国、英国等国知识产权部门的交流与互动,以多种形式积极开展国际交流合作。
十、加力营造知识产权人文环境
营造浓厚知识产权文化氛围。举办“4·26知识产权宣传周”活动,集中开展新闻发布、政策宣讲、要情通报、媒体见面活动。省市场监管局(知识产权局)发布知识产权“十大事件”“基层改革创新举措”和知识产权行政保护系列典型案例,营造知识产权文化氛围。省法院连续14年发布《广东法院知识产权司法保护状况》白皮书。省版权局开展“版权护航、筑梦青春”2024年广东省知识产权宣传周“版权进中学”活动,举办广东省第六届大学生版权知识演讲大赛、首届广东省版权公益短视频大赛。省商务厅举办“以法慧企,粤行越稳”涉外法律服务系列活动。省贸促会举办“广东省企业国际化经营风险应对服务月”等活动。省司法厅将知识产权法律法规宣传列入全省普法依法治理工作要点,省林业局将《种子法》列入2024年度普法要点。
加强知识产权人才队伍建设。2024年全国专利代理师资格考试广东参考考生达7074人,数量居全国首位。“粤港澳大湾区国际知识产权人才港”与“粤港澳青年商标品牌交流实践基地”启动深度合作,数十家知名企业正式入驻粤港澳大湾区国际知识产权人才港,为粤港澳三地人才培养提供知识产权交流、合作的专业平台。组织赴新加坡开展广东知识产权管理人才国际化培训。依托东莞松山湖高新技术产业开发区科技成果转化中心和国家技术转移南方中心(深圳)两家国家技术转移人才培养基地,构建全省初、中、高级专业化复合型技术转移人才培养体系,累计完成培训96场,培养技术转移人才5776人次。其中2024年2家国家技术转移人才培养基地共开展培训29期,培养技术转移人才1530人次。
INTELLECTUAL PROPERTY RIGHTS PROTECTION IN GUANGDONG, CHINA IN 2024

In 2024, Guangdong adhered to the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, faithfully studied and implemented the guiding principles from the 20th National Congress of the Communist Party of China (CPC) and the Second and the Third Plenary Sessions of the 20th CPC Central Committee, the spirit of General Secretary Xi Jinping's important instructions on comprehensively strengthening IPR protection and the spirit of the important speeches and instructions made during his inspection tour of Guangdong, and complied with the work requirements of the CPC Guangdong Provincial Committee and Guangdong Provincial People's Government in vigorously implementing the Outline for Building an Intellectual Property Powerhouse (2021-2035), China, the Opinions on Strengthening the Protection of Intellectual Property Rights (IPR), and the National Plan for Protection and Application of IPRfor the 14th Five-Year Plan Period. In particular, the province established an efficient integrated IPR management system and steadily advanced IPR reform. It made overall planning and promoted the implementation of the IPR strategy, strengthened the law-based IPR protection, and improved the full chain IPR protection mechanism. The province stepped up the effort in becoming a demonstration province for the country's IP power and a world-class IP province within the Greater Bay Area (Guangdong-Hong Kong-Macao Greater Bay Area).
I. Promoting Overall Planningof IPR Protection
Strengthening the overall planning. Both the CPC Guangdong Provincial Committee and the Guangdong Provincial People's Government attach great importance to IPR protection. The Commission for Comprehensively Deepening Reforms of the CPC provincial committee convened a special meeting on issues related to IPR, and the provincial government held executive meetings to study and deploy key IPR initiatives. Besides, the Guangdong Provincial People's Government and the China National Intellectual Property Administration collaborated on the theme of "building Guangdong into a world-class province strong on IPR in the Greater Bay Area", and drafted the key tasks for 2025-2026 under this joint initiative, aiming to create a hub for IP international cooperation in the Greater Bay Area.
Enhancing law-based protection. The province continued to implement local IPR regulations including the Guangdong IPR Protection Regulations, the Guangdong Copyright Regulations, and the Guangdong Geographical Indication (GI) Regulations. The province issued policy documents such as the Implementation Plan for the Special Action on Patent Transformation and Utilization in Guangdong Province to vigorously promote the industrialization of patents. The Office of the Guangdong Provincial Joint Conference on Intellectual Property Strategy Implementation issued the 2024 Annual Progress Plan for Building Guangdong into a Province Strong in IPR and the Implementation of the 14th Five-Year Plan. The Guangdong Administration for Market Regulation (Guangdong Intellectual Property Administration) issued the Implementation Opinions on Strengthening Administrative Adjudication of Patent Infringement Disputes in the New Era in collaboration with the Department of Justice of Guangdong Province. Additionally, it released the Action Plan for Comprehensively Enhancing the Efficiency of Intellectual Property Public Services to Support All-Round Innovation (2024-2026).
Promoting Pilot Demonstrations. Guangzhou and Shenzhen accelerated the development of national IPR demonstration zones. Continuous efforts were made to develop 10 national pilot demonstration cities, 21 pilot demonstration counties, and 8 pilot demonstration zones. The province built 5 national pilot areas for innovative trade secret protection, including Guangzhou, Shenzhen, Zhuhai, Foshan, and Jiangmen, ranking first in China by the number of pilot areas. Besides, the province developed 24 pilot areas under the Golden Inner Bay Trade Secret Protection Innovation Program, along with more than 900 protection bases and service stations of various types. Two initiatives, namely "Guangzhou Development District in Guangdong Province pioneers multiple overseas intellectual property insurance schemes to support enterprises in going global" and "Guangdong Technology-transfer Center for the Commercialization of University Innovations expedites the transfer of university patents", were listed as exemplary cases in the third batch of typical cases for building a nation strong in IPR.
II. Vigorously Enhancing Coordinated IPR Development in the Greater Bay Area
Enhancing Guangdong-Hong Kong and Guangdong-Macao IPR cooperation. The province implemented the Guangdong-Macao IPR Cooperation Agreement (2023-2025)and concludedtheGuangdong-Hong Kong IPR Cooperation Agreement(2024-2025)to foster IPR cooperation and exchanges in the Greater Bay Area, thereby promoting high-quality development in the region. The province continued to enhance collaboration with the IPR departments of the Hong Kong and Macao Special Administrative Regions by jointly organizing a series of signature events in the Guangdong-Hong Kong-Macao Greater Bay Area, including the IP Creation and Utilization Conference, IP Trade Expo, High-Value Patent Portfolio Layout Competition, High-Value Trademark and Brand Cultivation Competition, and IP Talent Development and Talent Supply-Demand Matching Event. Additionally, the province held the Guangdong-Hong Kong-Macao Greater Bay Area Sub-forum of the Business of IP Asia Forum in Hong Kong to fully leverage the spillover benefits of IP brand activities in the Greater Bay Area, and organized the 2024 IP Seminar between the Chinese mainland and the Hong Kong and Macao SARs, as well as the IP public servant exchange event in the Pan-Pearl River Delta region. Notably, the Shenzhen-Hong Kong-Guangzhou Technology Cluster has been ranked second in the global innovation index for five consecutive years.
Promoting IPR reform and innovation in key areas of the Greater Bay Area. The Sino-Singapore Guangzhou Knowledge City continued to deepen a new round of comprehensive reform activities for IPR utilization and protection. The Office of the CPC Guangdong Provincial Committee for Law-based Governance issued the Work Plan on Supporting the Construction of a Benchmark Zone for IP Legal Protection in the Sino-Singapore Guangzhou Knowledge City, fully supporting the Sino-Singapore Guangzhou Knowledge City in becoming China's first benchmark zone for IP legal protection. Focusing on the needs of foreign-related legal development, the Guangzhou Intellectual Property Court facilitated the establishment of the Nansha Tribunal, which specializes in handling foreign-related and Hong Kong/Macao-related cases. The Nansha District of Guangzhou launched the Guangdong-Hong Kong-Macao Innovation and Entrepreneurship IP Integrated Service Platform. The Hetao zone in Shenzhen (specifically the Shenzhen-Hong Kong border area) was approved to establish a national pilot platform for the international transformation of IP operations. Guangzhou Development District is developing a digital integrated IP service platform.
III. Strengthening Judicial IPR Protection
Giving full play to the judicial functions of IPR trials. In 2024, all courts across the province received 83,308 new IPR cases of various types, representing a year-on-year decrease of 8.54%. They concluded 88,462 cases, with a clearance-to-receipt ratio of 106.19%, up 2.36% year-on-year. There were 11,337 pending cases, a significant reduction of 31.17%. Great efforts were made to substantially resolve disputes, with 50,932 cases withdrawn through mediation, and the withdrawal rate increased by 4.89% year-on-year. Overall, the performance and efficiency of trials improved, and the effectiveness of case handling continued to show a positive trend. Efforts were intensified to enhance judicial IPR protection, with damages in civil IPR cases across the province totaling RMB 8.85 billion. The infringement dispute case of Baidu Netdisk's "offline download" concluded in 2024 had innovatively proposed the governance framework of "two preventions and one obstruction" and adjudication rules for the cloud storage industry, thereby fostered the standardized development of the digital economy in cyberspace. The concluded case of Chaozhou woodcarving, an intangible cultural heritage, explored a Guangdong-specific approach to enhancing judicial protection of national intangible cultural heritages and revitalizing traditional crafts, thus preserving and promoting excellent traditional Chinese culture. By proactively exercising judicial jurisdiction of Chinese courts, courts in the province efficiently resolved a series of foreign-related IPR disputes involving technology innovation enterprises, facilitating comprehensive settlements of both domestic and international disputes. The courts in the province achieved remarkable results in cultivating high-quality case precedents. The concluded case of "scraping and trading Weibo data by invoking server API interfaces" was selected as one of the top 10 IPR cases handled by Chinese courts in 2023. Four IPR civil judgments were recognized as outstanding in the 6th and 7th National Top 100 Judicial Documents competitions. Three cases, including the case of Unilever v. Guo et al. over trademark infringement and unfair competition, were selected as top 10 cases by the Quality Brand Protection Committee of the China Association of Enterprises with Foreign Investment. The "Judges-Enterprises Face-to-Face" IPR protection publicity event was organized, where senior judges provided precise and accessible legal advice to address the judicial needs of enterprises in innovation and industrial development.
Continuously strengthening the prosecution of IPR cases. In 2024, procuratorial organs across the province stepped up efforts to combat IPR infringement crimes, approving the arrest of 1,854 suspects involved in 1,265 IPR infringement cases, representing year-on-year increases of 64.29% and 68.24% respectively.They initiated prosecutions against 3,192 suspects in 1,779 cases, marking year-on-year increases of 61.73% and 62.94% respectively. IPR prosecution efforts were further advanced. Prosecutorial organs across the province accepted 228 cases of civil supervision of IPRs, including 34 cases with procuratorial advice to the courts for retrial.Besides, theyfiled and handled 49 public interest litigation cases related to IPR, and raised procuratorial advice on 42 cases, all of which received support from administrative organs, effectively safeguarding national or social public interests.The legal supervision function was fully leveraged, overseeing the filing of 20 cases (20 individuals) by public security organs and the withdrawal of 19 cases (31 individuals). The Guidance on the Establishment of a Criminal Protection System for Trade Secrets (Trial Implementation) was jointly promoted nationwide by seven ministries and commissions of the country, including the National Development and Reform Commission.
Strictly combating IPR infringement crimes. Public security organs across the province carried out in-depth special operations under the "Kunlun" campaign and organized a concentrated crackdown operation codenamed "Blue Sword" against IPR infringement crimes, maintaining a high-pressure and severe stance against crimes involving IPR infringement and the production and sale of counterfeit and substandard goods. In 2024, a total of 2,249 IPR-related criminal cases were filed across the province, representing a year-on-year increase of 5.8%. 1,926 cases were solved, with the solution rate rising by 10.12% and 2,653 suspects were transferred for prosecution. Both the quantity and quality of the investigation and handling of relevant criminal cases have seen significant improvements.
IV. Deepening Overall AdministrativeIPR Protection
Continuously strengthening administrative law enforcement for IPR protection. The Guangdong Administration for Market Regulation (Guangdong Intellectual Property Administration) carried out special actions such as the "Guarding IPR" initiative, the geographical indication protection initiative, and investigated and handled 3,945 IPR-related cases involving a total value of RMB 82.5006 million, and transferred 167 cases to judicial authorities, to continuously intensify the penalties for intellectual property infringements. The Utility Model Patent Infringement Dispute over the Film Pre-Pressing Device for Window Film Cutting Machines Case, the Infringement of the Exclusive Right to Use the Registered Trademark "Xiaomi" Case and other 3 cases were selected as typical cases of national IPR administrative protection in 2023. The practice of electronic evidence collection empowering IPR law enforcement and case handling was selected as a best practice by the State Administration for Market Regulation in IPR law enforcement. Continuous efforts were made to rectify business practices involving IPR infringement and counterfeiting in the cultural market, with over 20,000 reports and complaints handled. The Forestry Administration of Guangdong Province carried out special operations to protect IPRs related to forestry, inspecting a total of over 200 forest and flower seedling businesses as well as propagation farms and production sites. The Department of Agriculture and Rural Affairs of Guangdong Province launched special actions against counterfeiting of agricultural materials, with 279 cases handled and 8 cases transferred to judicial authorities pursuant to law. In 2024, a total of 5,036 credentials were granted to law enforcement officers across the province. 537 law enforcement authorities in the IPR field and more than 23,000 law enforcement officers across the province used the "Guangdong Law Enforcement" app, processing a total of 2,733 cases online.
Advancing the demonstration project for administrative adjudication of patent infringement disputes. Events such as seminars on administrative mediation and adjudication practices, as well as workshops on enhancing the capabilities of technical investigators for administrative IPR protection were organized to improve the administrative adjudication capabilities and standardize case-handling practices across the province. Cities such as Shantou and Zhongshan pioneered in China, entrusting local IPR protection centers and rapid IPR protection centers with administrative adjudication of patent infringement disputes. A "dual support" mechanism for technical consultation and technical investigation in IPR infringement judgement was established, providing technical support for grassroots administrative protection efforts from both neutral third parties and administrative agency assistants. A total of 10,445 patent infringement disputes were handled across the province, including 1,433 cases of administrative adjudication and 9,012 cases of rights protection opinion issuance. These efforts served as an effective "diversion valve" for resolving IPR disputes, facilitating rapid dispute resolution and enhancing rights protection efficiency.
Strengthening administrative law enforcement and regulation for copyright protection.The Copyright Administration of Guangdong Province, in collaboration with the Guangdong Communications Administration, the Guangdong Provincial Public Security Department, and the Guangdong Internet Information Office, launched special campaigns such as the "Jianwang 2024" initiative combating online copyright infringement and piracy, the youth copyright protection season action and the special action of cinema movies copyright protection. These efforts continuously intensified the crackdown on copyright infringement and piracy. In 2024, a total of 43,667 law enforcement officers were deployed across the province to inspect 26,655 venues and monitor 5,352 websites, with 370 cases investigated and handled. Both the quantity and quality of copyright cases handled were further enhanced. Two cases were listed among the first batch of typical cases in building a country with strong copyright protection.
Strengthening law enforcement by the customs for IPR protection. The Guangdong Sub-Administration of the General Administration of Customs of China (GACC) launched a series of special campaigns, including the "Longteng Action 2024", the "Lanwang Action", and the "Jingwang Action". In 2024, the customs authorities across the province seized 14,420 batches of infringing goods, totaling 34.78 million pieces. During the 3 law enforcement actions for IPR protection jointly launched by Guangdong Sub-Administration of GACC and the customs authorities in Hong Kong and Macao, 3,849 batches of IPR-infringing goods were seized, totaling 1.59 million pieces.
Enhancing the IPR governance in key sectors and critical areas. Guangdong continued to promote the implementation of national standards such as the IPR Protection Standards in Commodity Trading Markets and the IPR Protection and Management on E-commerce Platforms. The province advanced the standardization of IPR protection in commodity trading markets like the Guangzhou Baima Clothing Market, and launched a special campaign in 2024 to ensure compliance and development of online market. Guangdong strengthened IPR protection for major events, including the 15th National Games, the 12th National Paralympic Games, and the 9th National Special Olympics. Additionally, the province fulfilled IPR protection tasks with high standards for major exhibitions, including the 135th and 136th China Import and Export Fair (Canton Fair), the 20th China (Shenzhen) International Cultural Industries Fair, the 14th China International Animation Copyright Fair, and the 2024 South China Book Festival.
V. Comprehensively Promoting Coordinated IPR Protection
Enhancing coordinated IPR protection. Guangdong Administration for Market Regulation (Guangdong Intellectual Property Administration) and other 7 departments issued and implemented the Division of Tasks to Carry out the Implementation Plan for the Development of the Intellectual Property Protection System. Guangdong Intellectual Property Administration collaborated with Guangzhou Intellectual Property Court and Guangdong Government Services and Data Management Bureau to protect data rights and interests. The High People's Court, the Copyright Administration, and the Department of Culture and Tourism of Guangdong Province jointly promoted the work of addressing the root causes of copyright infringement disputes in the KTV industry. The number of newly accepted KTV-related copyright infringement cases in courts across the province decreased by over 30% year-on-year. Guangzhou Intellectual Property Court reinforced the "administrative mediation + judicial confirmation" mechanism coordination with the local market regulation administrations of 11 cities, and explored the establishment of a priority review channel of patent invalidation requests in litigation cases.
Deepening cross-regional protection cooperation. Guangdong actively engaged in the IPR Protection Collaboration Campaign of 12 Provinces and Municipalities, and facilitated the establishment of clue transfer channels for IPR cases. Cross-regional IPR protection work conference was held by 9 cities in the Pearl River Delta. A framework agreement on cross-regional IPR cooperation was signed by 12 cities in eastern, western, and northern Guangdong. The mechanism of copyright law enforcement cooperation among Pearl River Delta, eastern, western and northern parts of Guangdong was refined. The first cross-provincial judicial protection cooperation mechanism for ceramic geographical indications in China was established by three cities in Guangdong, Fujian, and Jiangxi. Procuratorial organs in Guangzhou, Shenzhen, Beijing, Shanghai, Xi'an, and other cities jointly carried out collaborative IPR protection work of "dual-center" cities (city that is both comprehensive science center and technological innovation center).
Improving diversified mechanisms for resolving IPR disputes. The High People's Court of Guangdong Province, the Department of Justice of Guangdong Province, the Guangdong Provincial Federation of Returned Overseas Chinese, and the China Council for the Promotion of International Trade Guangdong Committee further refined the diversified mechanisms for resolving cross-border civil and commercial disputes, and coordinated to establish and improve a regular mechanism of communication, coordination and cooperation. The Guangzhou Intellectual Property Court, as China's first pilot court, established a coordination and cooperation mechanism for litigation and mediation with the Hong Kong International Mediation Centre. The Guangzhou Arbitration Commission constantly improved the IPR Online Dispute Resolution (ODR) mechanism which integrates negotiation, mediation and arbitration. It formulated procedural guidelines for IPR ODR and established a new model of "administrative disposal + arbitration mediation". Since 2021, the ODR platform has resolved over 1,000 cases with a total value exceeding RMB 10 billion. The mediation success rate of the platform is approximately 60%, far exceeding the national average for arbitration institutions. The Department of Justice of Guangdong Province promoted closer judicial-arbitration collaboration on IPR. The Shenzhen Court of International Arbitration and the Futian District Court established the Hetao Intellectual Property Judicial and Arbitration Collaborative Protection Center in Shenzhen's Hetao zone, providing a one-stop service platform that aligns with international standards for IPR disputes. In 2024, arbitration institutions across the province handled 742 IPR arbitration cases with value of the subject matter of approximately RMB 1,036 million. The province is home to 167 mediation organizations for IPR disputes with 1,360 mediators, handling over 6,100 IPR cases in 2024.
Enhancing rapid collaborative IPR protection system development. Two rapid IPR protection centers were approved to be established in Panyu, Guangzhou (specializing in jewelry and animation) and Kaiping, Jiangmen (specializing in plumbing and sanitary ware). Across the province, 15 national-level IPR protection centers and rapid IPR protection centers have been set up, which accepted 52,300 pre-examination applications and 16,100 IPR protection cases throughout the year. Six local sub-centers for guiding the response to overseas IPR disputes have been established, which provide guidance services to over 1,000 enterprises. Training programs and publicity events on overseas IPR protection were organized, benefiting over 5,000 enterprises.
VI. Strengthening High-Quality creation of IP
Continuously promoting key indicators of IP to lead the country. In 2024, in Guangdong Province, the number of patents granted was 692,600, of which 168,800 were invention patents; applications for PCT international patents were 23,400. Trademark registrations were 824,500 and Madrid international trademark applications were 2,226. Besides, 108,700 invention patents were granted to strategic industrial clusters in the province. By the end of 2024, in Guangdong, the number of valid invention patents was 792,300, the number of high-value invention patents was 367,700, the number of applications for PCT international patents was 304,700, and the number of valid trademark registrations was 9,064,600, all ranking first in the country. A total of 332,200 copyright registrations were made in the province, of which 282,700 were computer software works, accounting for 10% of the country's total and ranking first in the country in terms of computer software copyright registrations. In the year, the number of new applications for new varieties of agricultural plants was 486 (totaled up to 3,467 applications) in the province, and 84 (totaled up to 1,252) new varieties of agricultural plants and 87 (totaled up to 380) of new varieties of forestry plants were newly granted.
Strengthening guidance for innovation in key industries. The province organized and conducted patent navigation for key industries, with 448 navigation achievements registered on the national platform. 9 national-level patent navigation service bases and 3 national patent navigation project support service institutions were approved to be established in the province. Twenty IPR collaborative operation centers for strategic industrial clusters were established, and 54 patent-specific databases were built to promote collaborative industrial innovation.
Reinforcing the dominant position of enterprises in innovation. Across the province, over 17,000 enterprises passed the national standard certification for IPR management. 865 enterprises initiated pilot projects for innovation management in accordance with international IPR standards, 117 of which were certified. The province is home to 1,243 national IPR demonstration enterprises and 573 high-value patent cultivation and layout centers. Across the province, 88,500 enterprises collectively hold 688,200 invention patents, accounting for 87% of the province's total valid patents.
VII. Accelerating the Realization of Benefits of IPR Utilization
Improving the mechanism of IPR transfer and transformation. Guangdong carried out the Implementation Plan for the Special Action on the Transformation and Utilization of Patents in Guangdong Province to advance the transformation and utilization of patents. The province released the Implementation Plan for Reform of Job-Related Technological Outcomes Management in Guangdong Province (2024-2027) and the Guidance for Determination of Due Diligence and Exemption from Liability for the Transformation of Job-Related Technological Outcomes in Universities and Research Institutions in Guangdong Province (Trial Implementation)&
